These Privacy policy shall foster trust among RC-Photo-Stock and its members. They shall prevent abusive conduct and safeguard highest quality.

Data Protection is an important topic for us. Thus we comply with the regulations of the EU General Data Protection Regulation (GDPR), the Federal Data Protection Act (BDSG) as well as other European regulations and would like to inform you in this privacy policy in detail and transparently about the processing of your personal data.

Personal data are all data that can be related to you personally, e.g. name, address, e-mail addresses or user behavior. With regard to the other terms used in the following, such as "controller" or "processor", we refer to the definition catalog of terms in Art. 4 GDPR.

2. Type of data and purpose of the processing of personal data

We only process personal data if you have given your consent or if this is permitted by law. The most important and for us pertinent permissions can be found in Art. 6 para. 1 GDPR. These concern in particular the case,

  • ― that you have given your consent, cf. Art. 6 para. 1 sentence 1 lit. a in conjunction with Art. 7 GDPR,
  • ― that the processing of your data is necessary for the fulfilment of our contractual obligations, see Art. 6 para. 1 sentence 1 lit. b GDPR,
  • ― ― or that the processing is carried out on the basis of our legitimate interests (e.g. increasing economic efficiency, analysis and further development of our products), cf. Art. 6 para. 1 sentence 1 lit. f GDPR.

a. Informational use of RC-Photo-Stock

When using the website for informational purposes only, we only process personal data that your browser transmits to our servers.

When you use our website, we collect the following data on the basis of our legitimate interests in accordance with Art. 6 Para. 1 S. 1 lit. f GDPR, which is technically necessary for us to display the website and to guarantee data security and the stability and security of our IT systems:

  • ― IP address in anonymized form: Our hoster only stores anonymized IP addresses of visitors to the website. At web server level, this is done by storing an IP address 123.123.123.XXX in the log file by default instead of the actual IP address of the visitor, e.g. 123.123.123.123, where XXX is a random value between 1 and 254. It is no longer possible to establish a personal reference. That information is stored for a maximum of seven days, as is usual in the industry. Afterwards they are anonymized.
  • ― the type of browser used and the browser version, (if transmitted by the user);
  • ― the operating system;
  • ― the date and time of the server request;
  • ― the number of visits;
  • ― the length of stay on the website;
  • ― the previously visited website (if provided by the user).

The processing of the IP address serves to protect against or to trace back cyberattacks. The processing of the remaining data serves to deliver the contents of our website, to ensure the functionality of our information technology systems, to optimize our website and to ensure the functionality of the website. The data of the log files are always stored separately from other personal data of the users. This processing of your aforementioned data is necessary to protect our legitimate interests and is justified by a balancing of interests in our favor.

We have a legitimate interest in ensuring that the website and the services offered technically work and are protected from attacks. Your legitimate interest in ensuring that your above-mentioned data is not used for this purpose does not outweigh our legitimate interest, since we use this data appropriately in accordance with the described processing purpose and you also benefit from the functionality of the website.

b. Registration of a customer account

When registering to use our services, some personal data is collected, such as name, address, contact and communication data (e.g. telephone number and e-mail address). If you are registered with us, you can access content and services that we offer only to registered users. Registered users also have the option of changing or deleting the data provided during registration at any time if necessary.

Within the scope of the registration process for our platform, the provision of the following data is obligatory and necessary for the execution of the registration:

  • ― Status: Private as consumer (§ 13 BGB) / Business as entrepreneur (§ 14 BGB))

We use the data you provide exclusively for the purpose of fulfilling the contract in accordance with Art. 6 Para. 1 lit. b GDPR, in order to enable you to participate on our platform.

In addition, you can voluntarily provide us with further data which we may process for the purpose of processing customer inquiries and for queries based on our legitimate interests in accordance with Art. 6 Para. 1 lit. f GDPR. This may include, for example, your sales tax identification or telephone number.

c. Contact form

If you contact us by e-mail or via our contact form, the data provided by the user (your e-mail address, your name and telephone number, if applicable, etc.) will be stored by us in order to process and answer your questions; the legal basis is Art. 6 para. 1 p. 1 lit. f GDPR.

d. Payment processing

For the purpose of payment processing, we offer our customers and interested parties user-friendly and secure payment options and use other payment service providers (currently PayPal) in addition to banks and credit institutions.

The purpose of processing is the handling of payments for the fulfilment of the contract or for pre-contractual inquiries (legal basis is Art. 6 para. 1 p. 1 lit. b GDPR). The processing is necessary to carry out the payment. The data entered will only be processed and stored by the respective payment service providers. We do not receive any account or credit card related information, but only positive or negative feedback from the payment processing.

In addition, the processing is intended to prevent fraud and abuse in online payment procedures (legal basis is Art. 6 para. 1 p. 1 lit. f GDPR). For this purpose, cookies with a duration of 12 months may be used directly from our website.

The following data may be processed within the scope of payment processing:

  • ― Name, address, contact information
  • ― Bank details, invoices, payment history, credit card data
  • ― Subject matter of the contract, duration of the contract, customer category, if applicable,
  • ― Usage data (e.g. websites visited, access times and duration),
  • ― Meta/communication data (e.g. MAC addresses, IP addresses).

3. Cookies

In order to make visiting our website attractive and to enable the use of certain functions, we use so-called cookies on the basis of our legitimate interests according to Art. 6 Par. 1 S.1 lit. f. GDPR or on the basis of your consent in accordance with Art. 6 Paragraph 1 S.1 lit. a GDPR on various pages. Cookies are small text files which are stored on the user’s device. Some of the cookies we use are deleted after the end of the browser session, i.e. after closing your browser (so-called session cookies).

We use various types of cookies that you can control through our cookie banner:

  • ― Temporary or session cookies are cookies that are deleted after you leave our website and close the browser. Common examples of such cookies are language settings or the contents of a shopping cart.
  • ― Permanent cookies are those that remain stored even after the browser is closed. For example, the login status or entered search terms can be saved. Such cookies can be used, among other things, for range measurement, marketing purposes or for IT security purposes. Permanent cookies are automatically deleted after a specified period of time. The storage period can vary depending on the cookie. However, you can delete these cookies at any time in the settings of your browser or not allow such cookies at all.

You can also setup your browser in a way that you are informed when cookies are set and can decide individually whether to accept them or to exclude the acceptance of cookies for certain cases or in general. If cookies are not accepted, the functionality of our website may be limited.

In addition to first-party cookies, which are set by ourselves as the data controller, we also use third-party cookies from other providers. You will find information on corresponding third party cookies within the respective data protection information of the online offers.

We inform our users in our cookie and consent banner about the technically required cookies that we use on RC-Photo-Stock. With regard to consents granted, you have the possibility at any time to change the decision made there and to subsequently grant or revoke your consent. The cookie banner can be accessed at any time via the footer of our website.

4. Duration of storage of personal data or criteria for the storage period

Unless otherwise stated, we delete personal data after the storage is no longer necessary for the provision of our services and no legitimate interests on our part or legal storage obligations (e.g. § 147 German Fiscal Code, § 257 German Commercial Code) prevent deletion.

5. Recipient of the data; no unauthorized disclosure to third parties

We treat personal data with the utmost care. We only transfer data to third parties if this is necessary for the execution and processing of contractual relationships entered into, if you have given us your consent to do so, or if the transfer is otherwise permitted by relevant legal provisions.

We use various service providers as so-called data processor according to Art. 28 GDPR, who, like us, are subject to the provisions of European data protection law and who have committed themselves accordingly.

6. Facebook Login and Single Sign On (SSO) / Google OAuth 2.0 / Twitter Login

We allow users to log in to our website with their various social media providers (currently Facebook, Google or Twitter accounts). For this we use so-called Single Sign On (SSO) procedures.

SSO is the possibility for a user to log on to a website/platform with already existing access data of other online services without RC-Photo-Stock receiving these access data. By logging in via this SSO procedure, personal data of third party providers (Facebook, Google, Twitter) can be sent to us and from us to these providers (via API requests). This means information such as name, address, e-mail address, IP address, browser used, etc.

The authorization of API requests will only take place if the user actively decides to share this data with us via the SSO procedure and has been informed in advance of all necessary information for processing and has confirmed receipt of this information. The corresponding authorization takes place within the scope of the selected social media provider. The legal basis in this case is the consent according to Art. 6 para. 1 p. 1 lit. a GDPR.

Consent can be revoked at any time with effect for the future (Art. 7 para. 3 GDPR). The revocation can be exercised via the respective platform. Once consent has been revoked, the user can no longer log in via the SSO procedure of the respective social media provider until consent is granted again.

7. Protection of personal data

Through a bundle of technical and organizational measures in accordance with the current state of the art, we secure both our website and the data stored in our area of responsibility against loss, destruction, unauthorized access, changes or publication by unauthorized persons.

The input and transmission of personal data is encrypted using the SSL (Secure Socket Layer) method.

a. What is SSL?

A website encrypted with SSL transmits personal data encrypted to the server so that it is impossible for third parties to intercept or read them. Our identity is verified by a certificate. Depending on your browser, you can tell by the green address bar and/or the lock that a secure connection exists. By clicking on the lock or the green address bar you can read our online proof of identity.

b. What does SSL do?

By encrypting the transmission, you can assume that your entered data can only be read by us. You can see from the green address bar that you are connected to our server and that it is not the site of a third party.

8. Rights of the persons concerned

You have the following rights with respect to the personal data concerning you:

  • ― Right to information in accordance with art. 15 GDPR,
  • ― Right of correction or deletion according to Art. 16 GDPR or Art. 17 GDPR,
  • ― Right to limit processing in accordance with Art. 18 GDPR,
  • ― Right to data transferability according to Art. 20 GDPR,
  • ― Right to object to processing in accordance with Art. 21 GDPR.

9. Objection to the processing; revocation of consentn

If you have given your consent to process your data, you can revoke it at any time. Such revocation will affect the permissibility of processing your personal data after you have given it.

IN THE EVENT OF YOUR JUSTIFIED OBJECTION, WE WILL EXAMIN THE FACTS OF THE CASE AND WILL EITHER STOP OR ADAPT THE DATA PROCESSING OR SHOW YOU OUT COMPELLING REASONS WORTHY OF PROTECTION ON THE BASIS OF WHICH WE WILL CONTINUE PROCESSING.
